Basic Terms and Conditions
XTX Ltd provide services subject to the terms and conditions listed below:
Estimates
- Each client will be provided with one estimate free of charge and without obligation, even if this estimate requires a visit to assess the scope of the project.
- Estimates are valid for 30 days from the date of the estimate, during which time the client can decide on whether to proceed. After 30 days we reserve the right to adjust the estimate.
- Clients who seek estimates and then do not take up the offer may be subject to paying for time spent providing further estimates. This is necessary to prevent misusing my time or other tradesmen trying to use me as an estimating tool.
- We reserve the right to not provide an estimate, or to advise the client that the requested work is outside of my capability or scope of works.
- All estimates are subject to availability of stocks, materials and manpower.
- Please note that waste removal/disposal is not included in the quotations, unless specifically mentioned.
- Parking costs such as parking permits, Pay and Display etc are not included in the quotation unless specifically mentioned.
Fees
- A full list of fees is available on request.
- Fees relating to time spent fall into two categories – First hour (or part thereof) and hourly (or day rate if that is appropriate). The first hour charge is a one-off fee to cover travel to site, paperwork and the first hour of labour; all projects will incur the first hour fee except where arrangements have been made between the customer and XTX Ltd.
- The hourly rate (or day rate) is applied to each further hour (or day) or part thereof spent on-site.
- Preparation and clean-up time is also included in the calculation of time spent on a project.
- Once a particular project has been quoted for and accepted by the customer, any further changes will be invoiced and charged for separately.
Health and Safety
- XTX Ltd provide transport, tools, work wear and safety equipment for the work that we carry out.
- XTX Ltd try to ensure that the client and where applicable the client's family/staff are not placed in undue danger due to work being undertaken, however the client is required to provide their own safety equipment as is appropriate.
- Please ensure that your children are fully supervised to avoid the possible risk of injury.
- Please ensure that your pets are secured to avoid the risk of injury or disruption of works.
- Where electrical work is undertaken, the electricity may need to be turned off during works. The electricity will need to be turned off to carry out testing after electrical works are completed.
- It is the clients’ responsibility to ensure all computers and games consoles etc are turned off before the power is switched off and that fridges and freezers are working after the power is turned back on.
- The client is required to provide a clean and safe working environment. If we deem that carrying out work is likely to place us in danger, we reserve the right to terminate all work until the situation is remedied.
- For exterior cleaning work the customer is to provide a source of fresh water. Ideally an outside tap.
- For gutter cleaning work the customer is to provide a working 13A socket outlet to power the gutter vacuum.
Subcontracting
- XTX Ltd may subcontract work to another person/firm if this is deemed necessary.
- Subject to agreement, XTX Ltd will work as a subcontractor to another company.
- The client is responsible for the management and supervision of their own subcontractors unless prior arrangements have been made with XTX Ltd.
- Where XTX Ltd is used to repair a previous contractor’s work, the client will be solely responsible for payment. XTX Ltd will not involve themselves in any disputes between the previous contractors and the client.
Payment
- For one-off projects that take a week or less to complete, payment will be due on completion.
- XTX Ltd do not offer credit facilities.
- For projects which take longer than a week, we reserve the right to request payment on completion of each agreed upon stage in the project.
- On larger projects XTX Ltd may require an upfront payment for materials, before work commences.
- XTX Ltd will rigorously pursue anyone who does not pay on time, interest will be charged at 8% above the bank base rate, calculated from the date of the invoice (or the legal maximum if that is higher).
- If payment is delayed by more than 28 days, XTX Ltd reserve the right to instruct a debt collection agency to recover payment – including all expenses and interest.
Payment Options
- An invoice will be emailed to the customer on completion, which has multiple options for payment.
- Bank Transfer - You can pay XTX Ltd by transferring money directly into our bank account.
- Card – card payments can be made via the links in the emailed invoice.
- Cash – XTX Ltd will accept cash payments, but they will be processed through our books.
- Cheques - Please make cheques payable to XTX Ltd.
Guarantee
- We guarantee our workmanship for a period of 1 year from the date of completion.
- This guarantee does not extend to parts or materials which have been supplied by the client or which we have been instructed to use by the client or their agent. In these situations, the manufacturers guarantee takes precedence. Please note that if these materials fail then XTX Ltd would normally expect to charge for any time required to affect a replacement or repair.
- Our guarantee is immediately invalid if someone else, not acting on our explicit instruction interferes with any work that we, or our subcontractors, may have previously undertaken.
- For exterior cleaning work we cannot guaranty that weeds, moss, algae or other organic growth will not return. The only way to prevent regrowth is by regular applications of biocide or weed killer, as appropriate.
Remedies
- In the event that the workmanship fails within the guarantee period, at XTX Ltd.'s discretion, we will either put right the work at our own cost, or provide a refund to enable the customer to pay another tradesman to have that work put right (this refund may not be sufficient to cover the full cost of employing another tradesman).
- If work undertaken does not meet with the client’s approval or subsequently fails then the client shall be refunded monies paid, or if no money has been paid the client will be partially invoiced or not invoiced, as appropriate. No payment shall be due in relation to paying another contractor, either to put right work nor to pay for new or replacement materials.
- The client agrees that they are solely responsible for their own out-of-pocket expenses relating to any work undertaken by XTX Ltd.
- Where materials may have been paid for by the client and a full refund is given, the materials shall be returned to XTX Ltd. In this situation the client shall have no claim on the materials.
- The client may keep the supplied materials if they pay for them. In this case XTX Ltd shall have no claim to the materials once they have been paid for.
Force Majeure
- The client will appreciate that sometimes unplanned events will take place which interrupt previously planned arrangements.
- Whilst we will always use our best efforts to reduce or eliminate the effect of any unplanned event, we cannot be held liable if we are forced to change plans due to unforeseen circumstances or weather.
- Usually such a situation would only require a visit to be rescheduled, however that depends on the circumstance in every instance.
